Aviso Zeta AG (formerly Constantia Privatbank AG) to appeal first-instance district court ruling – rectification by higher courts expected

The Vienna District Court for Commercial Issues today issued a non-evidentiary, first-instance ruling in favour of a plaintiff. Aviso Zeta AG intends to appeal this ruling and is convinced that, as in many earlier cases, the decisions of the superior courts will support the position of Aviso Zeta AG.
Stefan Frömmel, member of the Executive Board of Aviso Zeta AG, on the current case: “In contrast to statements made by the Poduschka law firm, a first-instance ruling by a district court can in no way be interpreted as a ‘defeat’ or ‘setback’ for Aviso Zeta AG. Aviso Zeta AG (vormals Constantia Privatbank AG) wird gegen erstinstanzliches Urteil eines Bezirksgerichts berufen – Richtigstellung durch die Obergerichte erwartet

Heute hat das Bezirksgericht für Handelssachen Wien in einem erstinstanzlichen Urteil ohne Beweisverfahren zu Gunsten einer Klägerin entschieden. Dagegen wird die Aviso Zeta AG berufen und man ist überzeugt, dass wie bereits in vielen anderen Fällen die Obergerichte im Sinne der Aviso Zeta AG entscheiden werden.

IMMOFINANZ Group successfully continues portfolio optimisation

Since March 2012 IMMOFINANZ Group has sold four properties in Austria: two office buildings, one commercial building and a hotel. These transactions reflect the company’s strategy to sell properties that do not match the target portfolio with respect to size, location, quality or use. The proceeds on these sales amounted to over EUR 12 million and exceeded the carrying amount of the assets by a substantial margin. With the sale of the last project in Bosnia-Herzegovina, the Group has now also withdrawn completely from this market.
Sale of four properties in Austria These four sales represent a further step by IMMOFINANZ Group to optimise its portfolio. The above-mentioned office buildings represent a property in the Herbeckstrasse in Vienna and a property in the Itzlinger Hauptstrasse in Salzburg.
